Welcome to 321Click.ca  ("we," "us," or "our"). By using our photo booth services, you ("Client," "Customer," or "you") agree to the following Terms and Conditions. Please read them carefully.

1. Services Provided

321Click.ca  provides photo booth rental services for events such as weddings, parties, corporate events, and other occasions. Our services may include access to our photo booths, props, photo printing, digital copies of photos, and other features depending on the package chosen.

2. Booking and Payment

• Reservation: To reserve our photo booth services, a signed agreement and a deposit are required. The reservation is not confirmed until both the agreement and deposit are received.

• Deposit: A non-refundable deposit of 50% is due at the time of booking. This deposit is applied to the total event cost.

• Payment: Full payment is due 14 days before the event date. Payments can be made via Cash, credit card, e-transfer.

• Late Payment: If full payment is not received by the due date, we reserve the right to cancel the reservation and retain the deposit.

3. Cancellation and Refund Policy

• Client Cancellations: If the Client cancels the event, the deposit is non-refundable. Cancellation requests must be made in writing to 321Click.photobooth@gmail.com.

• Rescheduling: Rescheduling is subject to availability and may incur additional fees.

• Our Cancellation: In the event that we need to cancel our services due to unforeseen circumstances (e.g., equipment failure, illness, etc.), we will offer a full refund or provide a rescheduled date.

4. Event Setup and Operation

• Setup Time: The Client is responsible for providing sufficient time for the photo booth setup and breakdown. Setup typically takes 1 Hour before the event starts.

• Space Requirements: The Client must provide an adequate space at the event venue for the photo booth. Specific space requirements will be communicated upon booking.

• Power Supply: The Client must provide access to a standard electrical outlet (110V) near the photo booth setup area.

• Props and Equipment: We provide props and equipment for the photo booth. The Client is responsible for ensuring that no damaged or broken items are returned.

5. Client Responsibilities

• Event Details: The Client must provide accurate event details, including event date, venue, and contact information, at the time of booking.

• Venue Access: The Client must ensure the venue allows our team access to set up and operate the photo booth. The Client is responsible for any venue restrictions that may impact our services.

• Behavior: The Client is responsible for ensuring that guests use the photo booth appropriately and follow any instructions provided by our staff.

• Liability: The Client is responsible for any damage to our equipment caused by guests during the event.

6. Photographs and Media

• Ownership of Content: The Client grants 321Click.ca the right to take, use, and reproduce photographs and videos taken at the event for promotional purposes, including on social media and our website.

·        Use of Photos for Marketing and Website

·        By using our photo booth services, you grant 321Click.ca the right to use any photos and videos taken during your event for marketing, promotional, and advertising purposes. This includes, but is not limited to, sharing images on our website, social media platforms, promotional materials, and advertisements. We respect your privacy and will ensure that all content used is in alignment with our privacy policy. If you prefer not to have your photos featured publicly, please inform us in advance, and we will make reasonable efforts to accommodate your request.

• Photo and Video Delivery: Digital copies of the photos will be provided to the Client after the event, typically within 7-14 days. We are not responsible for any delays in the delivery of media.

• Customizations: The Client may request customized photo prints or designs (e.g., logos, templates). Any customization requests must be submitted at least 15 days before the event.

7. Limitation of Liability

• Force Majeure: We are not liable for any failure or delay in performance due to causes beyond our control, including but not limited to natural disasters, accidents, strikes, power outages, or acts of government.

• Liability: Our total liability for any claim arising out of this agreement will not exceed the total amount paid by the Client for the services provided.

• Equipment Failure: While we strive to provide high-quality service, we are not responsible for any technical issues or equipment failure that may occur during the event. In the event of a technical failure, we will make reasonable efforts to resolve the issue promptly.

8. Privacy and Data Protection

• Personal Information: We collect and store personal information as described in our Privacy Policy. We will not share your personal information with third parties without your consent unless required by law.

• Photo Use: By using our photo booth services, you consent to the use of your photos in accordance with our Privacy Policy and for marketing purposes.

9. Indemnification

The Client agrees to indemnify and hold 321Click.ca, its employees, agents, and subcontractors harmless from any claims, liabilities, damages, or expenses arising from the use of our services, including but not limited to claims related to personal injury, property damage, or theft.

10. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.

11. Amendments

We reserve the right to amend or update these Terms and Conditions at any time. The updated version of these Terms and Conditions will be posted on our website.
